In February and March 2026, the US Department of the Treasury released a Financial Services AI Risk Management Framework, the first regulatory framework designed specifically for artificial intelligence governance in banking and financial services. Unlike NIST's general-purpose AI RMF or the 15-year-old SR 11-7 model risk letter, the Treasury framework bridges the gap between abstract AI principles and the concrete operational and regulatory realities banks face. The framework was developed collaboratively with more than 100 financial institutions through the Financial Services Sector Coordinating Council (FSSCC) and the Cyber Risk Institute, drawing on the lived experience of banks, credit unions, investment firms, and insurance companies deploying AI across lending, trading, compliance, and operations. This stakeholder-intensive development process means the framework reflects not what regulators think banks ought to do in theory, but what leading banks are actually doing in practice and what gaps remain.
The Treasury framework organizes AI governance around 230 specific control objectives distributed across NIST's four core functions: Govern, Map, Measure, and Manage. However, the Treasury version translates generic NIST language into banking-specific requirements that tie directly to existing regulatory obligations. Under Govern, for example, the framework includes control objectives addressing how banks should establish AI governance structures that satisfy expectations in existing guidance around internal controls and management oversight. Under Map, it includes objectives specific to identifying AI systems in regulated banking activities: not just any AI, but AI that touches critical functions like lending decisions, fraud detection, and compliance monitoring. Under Measure, the framework specifies how banks should validate AI systems in high-risk contexts like algorithmic lending, where fair lending laws (ECOA, Fair Housing Act) create legal liability if AI produces discriminatory outcomes even unintentionally.
The comprehensiveness of 230 objectives reflects the complexity of applying AI across a modern bank. A single community bank might have fewer distinct AI systems and could prioritize a smaller subset, while a large universal bank managing AI in trading floors, retail lending, corporate advisory, and regulatory compliance needs a more expansive program. The framework is intentionally granular so that institutions of different sizes and sophistication can scale their approach, but the underlying principles (accountability, documentation, validation, monitoring) apply everywhere.
A key strength of the Treasury FS AI RMF is that it is explicitly designed as an integrating layer, not a replacement for existing law. NIST's AI RMF is intentionally general-purpose and voluntary. It applies equally to manufacturers, healthcare providers, autonomous vehicle developers, and financial institutions. NIST says nothing about fair lending, nothing about systemic risk, nothing about customer protection in a banking context. The Treasury FS AI RMF, by contrast, is specifically written for banking and financial services and is non-binding but carries the implied backing of bank regulators. Another key difference is enforcement posture. NIST compliance helps banks build a safe harbor defense against liability, but Treasury guidance is expected to flow into actual supervisory expectations. Regulators have a long history of issuing guidance documents, then incorporating them into examination procedures and supervisory expectations. Banks that lag in adopting Treasury FS AI RMF control objectives are likely to encounter examination findings and supervisory pressure well before new regulations are written. The timing here is strategic: by publishing this framework in early 2026, Treasury is signaling to banks what the regulatory baseline will be, giving them time to build programs and demonstrate progress before exams intensify.
The Treasury FS AI RMF is non-binding guidance, not a rule. Treasury itself has no direct enforcement authority over banks: that power lies with the Federal Reserve, OCC, and FDIC. However, Treasury is actively coordinating with banking regulators on supervisory expectations, and early bank regulatory communications have indicated that the framework will inform examination priorities. Banks should expect that during regulatory examinations, examiners will review AI governance practices against the Treasury framework's control objectives. If a bank has not adequately addressed high-priority control objectives (particularly around fair lending, systemic risk, or third-party vendor management), examiners will likely issue findings or matters requiring attention.
Enforcement pressure will escalate over time. Initial exam cycles will likely focus on whether banks have documented their AI systems and assigned accountability, which is relatively easy to address. Later exam cycles will scrutinize the depth of validation, the quality of monitoring, and the rigor of governance decision-making. Banks that have invested in mature AI risk programs now will weather these exams smoothly. Those that treat the framework as optional are likely to face consent orders and corrective action letters similar to what some banks have experienced with model risk deficiencies.
The Treasury FS AI RMF signals a regulatory consensus that has been building since 2023: AI governance is no longer optional for banking institutions. The framework clarifies what "mature" AI risk management looks like and establishes a common language between banks and regulators. For banks already compliant with SR 11-7 and focused on model governance, the Treasury framework is largely an extension: applying familiar principles to newer AI modalities. For banks that have not yet invested seriously in model risk infrastructure, the framework serves as a wakeup call: the work that should have been done over the past 15 years for traditional models is now urgent for AI models.
Operationally, this means banks need to conduct a rapid inventory of AI systems, prioritize the highest-risk ones (those affecting customers, those making automated decisions, those handling sensitive data), and ensure those systems have documented development, independent validation, ongoing monitoring, and clear governance. For many mid-size and large banks, this is a significant effort. For small banks, it may be prohibitive without external help or consortial approaches. The framework also underscores the importance of third-party risk management: if a bank contracts with a cloud vendor, a GenAI provider, or a third-party model vendor, it must apply the same governance rigor to those external systems as to internal ones.
