Consent Architecture Erosion

Agent purpose determined by prompt, not application architecture. Same agent serves different purposes in successive interactions. Consent scope erodes incrementally through use, not through a discrete change.

The Risk

Privacy frameworks require institutions to define the purpose for which personal data is processed. GDPR's purpose limitation principle, PDPA's purpose specification requirement, HIPAA's minimum necessary standard, and equivalent frameworks in all jurisdictions all require that processing purposes be explicitly defined, communicated to data subjects, and limited to those specified purposes. Purpose is typically encoded in application architecture: a "loan underwriting system" is designed for loan underwriting. The application cannot be repurposed without deliberate architectural change.

Agents break this assumption because the purpose of an agent can be changed by changing the prompt, without changing the application or infrastructure. The same agent instance can be used for loan underwriting in one interaction, marketing analysis in the next, and fraud detection in the third. The data subject consented to one purpose but their data is now being processed for a different purpose. The consent architecture assumes purpose is stable; agent deployment makes purpose ephemeral and user-invisible.

Consent erosion occurs incrementally. An agent deployed for a specified purpose has data access permissions scoped to that purpose. A new request comes in: could the agent also help with a related purpose? The agent's prompt is modified to include the new purpose. The data access permission is expanded slightly. The data subject is unaware their data is now being used for a broader purpose. Downstream, a third purpose is added. Gradually, the agent's actual purposes expand far beyond the originally consented purpose, and the consent architecture never triggers notification or re-consent.

How It Materializes

A UK insurance company deploys an agent to analyze underwriting data for auto insurance quotes. The agent's consent language is: "Your data will be processed to assess your eligibility for auto insurance and provide a quote." The agent has access to the customer's driving history, accident records, and claims history. Customers are informed of this use when they apply for quotes.

Over time, the business development team requests that the same agent be repurposed to identify cross-sell opportunities for home insurance. The agent's prompt is modified to include "identify customers likely to have home insurance needs based on correlation between driving behavior and property stability." The agent's data access is expanded to include address history and residential stability signals. The architectural change is invisible: same agent, modified prompt. Customers whose data is now processed for home insurance cross-sell purposes were never asked for consent. They consented only to auto insurance underwriting. The agent now processes their data for a new purpose without consent.

Months later, the marketing team requests that the agent help identify customers for targeted advertising. The prompt is modified again: "recommend marketing messages that would resonate with this customer based on driving behavior patterns." The agent now processes data for a third purpose (marketing targeting). Customer data is being processed for purposes the customer never consented to, but because the architectural change is prompt-based rather than infrastructure-based, the privacy governance system does not see a change. The consent architecture remains stable; the actual consent scope erodes.

A data subject later exercises right of access (GDPR Article 15, PDPA Section 21). They are entitled to know what purposes their data is processed for. The insurance company's records now show three purposes (auto underwriting, home cross-sell, marketing targeting). Only one purpose (auto underwriting) was explicitly consented to. The company has processed personal data without valid legal basis. The data protection authority issues an enforcement notice.

Why This Matters in Regulated Industries

Privacy is the regulatory foundation of customer trust. If customers discover their data is being processed for purposes they did not consent to, trust is broken. Financial regulators, healthcare regulators, and data protection authorities all expect institutions to maintain stable, transparent purposes for personal data processing. An institution that allows agent prompts to drift purposes without updating consent or notifying customers is in violation of privacy frameworks.

The risk is particularly acute because it is systematic and invisible. Consent erosion happens across many agents and many prompt modifications. By the time a regulator or data subject discovers the issue, the scope of the violation is large. Remediation is expensive: customers must be notified, past processing must be justified or results deleted, new consent must be obtained.

Controls & Mitigations

Design-Time Controls

  • Establish an "agent purpose freeze": at design time, explicitly document the purposes an agent is permitted to serve. Record these purposes in Component 1 (Agent Registry). Prohibit prompt modifications that change declared purposes without governance review.
  • Implement a "purpose commit" mechanism: require anyone modifying an agent's prompt to declare whether the modification changes the agent's purpose. Trigger governance review and consent re-collection if purpose changes.
  • Design agent prompts to explicitly declare purpose at the beginning: "This agent processes personal data for the purpose of X. It will not process data for any other purpose." Make the declared purpose immutable or subject to governance approval.
  • Require all agent prompts to include consent scope disclaimers visible to the agent operator or user: "Consent for this use case covers: X, Y, Z. This agent is configured to only process data for these purposes."

Runtime Controls

  • Implement prompt change logging: capture every modification to agent prompts, record the change, the timestamp, and the team making the change. Make logs immutable and queryable.
  • Use Component 3 (JIT Authorization Broker) to intercept prompt changes that appear to modify agent purpose. Require purpose change authorization before allowing the modified prompt to execute.
  • Implement prompt-to-purpose mapping: for every agent prompt in production, maintain a mapping to consented purposes. During runtime, validate that the agent's actual purpose (inferred from prompt) matches documented consent. Halt agents operating outside consent scope.
  • Use Component 10 (Kill Switch) to automatically halt any agent whose prompt modifications indicate purpose drift beyond documented consent.

Detection & Response

  • Conduct quarterly agent purpose audits: for each agent, retrieve its current prompt, compare to documented purposes in Agent Registry, identify any purpose drift. Investigate discrepancies.
  • Monitor agent prompt change velocity: detect teams making frequent prompt modifications that might indicate incremental consent erosion. Flag for governance review.
  • Implement data subject right-of-access fulfillment: when customers request right-of-access, accurately document all purposes their data is actually processed for (based on current agent prompts), not documented purposes. Identify mismatches.
  • Establish consent erosion incident response: if purpose drift is discovered, immediately audit all affected agent executions, determine scope of non-consensual processing, notify affected data subjects, obtain retroactive consent or delete results, implement corrective actions.
