The Problem

Transfer pricing (TP) documentation is required annually by OECD BEPS Action 13 and is increasingly demanded by tax authorities globally. Identifies comparable arm's-length pricing for uncontrolled transactions (CUP comparables)
Performs statistical analysis: median, quartiles, outliers
Calculates arm's-length pricing:
If CUP method: Adjusts comparable uncontrolled prices for material differences (volume, credit terms, logistics costs)
If Cost Plus/Resale: Applies appropriate mark-ups based on comparable transaction data
If Profit Split: Allocates combined profit based on relative contributions or assets
Reconciles pricing to actual IC transaction prices; identifies variances requiring explanation
Generates TP documentation:
Master file: Summary of TP policies, FAR analysis, transfer pricing methods, documentation adequacy
Local file (by entity): Entity-specific documentation: FAR, local transactions, comparable analysis, transfer pricing method, calculation
Contemporaneous documentation: Supports TP positions and satisfies documentation requirements
Transfer pricing report: Audit-ready documentation that can withstand tax authority scrutiny
Tracks TP risk exposure:
Identifies high-risk transactions: Large-dollar intercompany transactions, subjective pricing (e.g., management fees), IP licensing
Calculates exposure to adjustment: If tax authority challenges pricing, what is the potential tax and penalty exposure?
